Roach Newton, LLP has an active statewide court of appeals practice.  Our attorneys work with the benefit of the insights of two former law clerks from the Fourteenth Court of Appeals.

Selected successes include:

  • Obtaining judgment that plaintiff insurer seeking restitution for policy funds paid take nothing on appeal of an adverse summary judgment.  Warren E&P, Inc. v. Gotham Ins. Co., 368 S.W.3d 633 (Tex. App.–El Paso 2012, pet. filed).
  • Reversal of a disgorgement judgment of over $4 million when the court of appeals enforced the parties’ release of future claims, including fraud.  No. 14-11-00125-CV, Texas Standard Oil & Gas, L.P., Grimes Energy Co., and PetroVal, Inc v. Frankel Offshore Energy, Inc., 2012 WL 6725614 (Tex. App.–Houston [14th Dist.] Dec. 28, 2012) (n.p.h.).
  • Affirming a summary judgment and favorable interpretation of an assignment of an oil and gas lease.  Tex. Indep. Exploration, Ltd. v. Peoples Energy Prod.-Texas L.P., n/k/a/Coronado Energy E&P Co., LLC, No. 04-07-00778-CV, 2009 WL 2767037 (Tex. App.–San Antonio 2009, no pet.) (not designated for publication).
